Job Description: LEGAL COUNSEL VACANCIES (Litigation and Enforcement) PURPOSE OF POSITION Accountable to provide litigation services and legal counsel as a member of the Litigation and Enforcement function for FSRA, which will support FSRA’s mandate and be responsible for the prosecution function. KEY RESPONSIBILITIES: Provides legal advice and assumes carriage of litigation matters for the enforcement of FSRA’s regulatory framework and to ensure high standards of business and market conduct in financial services sectors regulated by FSRA. Has carriage of regulatory enforcement and quasi-criminal matters and prosecutes before the Financial Services Tribunal and/or Provincial Court. Undertakes legal research and analysis on a variety of complex legal matters involving the regulation of financial services in Ontario. Handles all phases of litigation including representing FSRA with opposing counsel and third parties, tribunal and court hearings; attending pre-hearing conferences and negotiating settlements where appropriate. Provides legal guidance and drafts legal opinions on matters in litigation and makes recommendations with respect to future handling and resolution. Participates on litigation teams responsible for large, high profile, complex and/or joint investigations before the Financial Services Tribunal and Provincial Court that involve collaboration with law enforcement agencies and other regulators. Works closely with Market Conduct/compliance, Forensic Analysis and Investigations, Communications and Supervision teams to provide legal counsel and advice in the investigation of enforcement related risks and issues and to advise on litigation strategies in support of the overall enforcement strategy. Develops a range of legal products including pleadings, motions, briefs, discovery and other legal documents; ensuring adherence to quality assurance standards and legal/office policies and procedures. Drafts and/or provides input to the drafting of presentations for consideration of various executive and other committees for FSRA. Participates on FSRA project teams and committees to provide legal advice and support. QUALIFICATIONS Education and Experience Law degree from a recognized law school and member in good standing in the Law Society of Ontario. Intermediate Legal Counsel (4-7 years call to bar) Litigation experience in a regulatory environment and / or in private practice. Experience with public and/or regulatory law, an asset. Knowledge and Skills Understanding and legal training in litigation as it pertains to FSRA’s regulated sectors. Strong interpersonal skills and ability to build collaborative relationships with internal clients and the Market Conduct and Forensic Analysis and Investigations functions. Excellent written and verbal communication skills. Ability to thoroughly evaluate alternatives, innovate problem resolution, employ a pro-active approach, and take initiative to resolve problems. Ability to think and act independently and attentive to detail. Ability to manage and adapt to changing priorities. Ability to quickly grasp complex regulatory legal issues.
