ASTTBC is seeking an experienced Director, Enforcement (Director) to provide strategic leadership and operational oversight of its complaints, investigations, and discipline functions. The Director is a proven leader who works with the Registrar and Chief Executive Officer to deliver effective policy, operational, and administrative services that align with and allow the organization to meet its regulatory, strategic, and operational goals.
The Director is a member of the senior leadership team who reports to the Registrar and contributes to the development of and implementation of organizational strategies, policies, and practices for optimal performance of the organization in carrying out ASTTBC’s mandate as a regulator in British Columbia under the Professional Governance Act (2018) and International Credentials Recognition Act (ICRA) (2023).
This a full-time position working from Monday to Friday with the occasional change in work schedule to meet operational needs.
THE ROLE:
The Director is responsible for providing guidance on all enforcement files which include complaints, investigations and discipline, and also manages their own files. They lead the development and continuous improvement of enforcement processes to ensure registrants’ compliance to the Professional Governance Act (PGA), Bylaws, Standards of Competency and Code of Ethics. The Director assists the Registrar, CEO, and other staff to develop and implement organizational strategies, policies, and procedures to ensure ASTTBC meets its mandate under the PGA.
To support these functions, the Director develops policies and procedures. Working closely with staff in support of the work of ASTTBC’s statutory committees when needed: Investigation, and Discipline committees. The Director collaborates closely with the Practice Department to ensure that ASTTBC’s approach to communications and enforcement around practice guidance, standards of practice, ethics and code of conduct is unified and consistent. The Director manages a staff of two individuals.
Key Areas of Responsibility
- Staff lead and point of contact for the Investigations Committee (IC) and works with the IC Chair to ensure enforcement files are addressed in a reasonable timeframe and meet administrative fairness principles.
- Conducts duties of the Director makes decisions as specified in the Professional Governance Act, and ASTTBC Regulations and Bylaws and in compliance with the regulatory requirements under the International Credentials Recognition Act and to the standards of good governance set by the OSPG.
- Manage complaints and investigations: Receive and respond to complaints; conduct preliminary assessments and triage (jurisdiction, public risk, next steps); gather evidence through interviews, document review, and third-party inquiries.
- Analyze findings and support decision-making: Evaluate evidence and technical reports, develop recommendations, and prepare clear, concise reports for the Investigation Committee.
- Develop and implement strategies to promote compliance, including education in partnership with other departments such as professional practice and registrations.
- Manage the intake, investigation, and closure of files related to Unauthorized Practice and Misuse of Title (“Enforcement Files”).
- Manage the enforcement team which includes complaints, investigations and discipline by providing strategic advice, reviewing and advising on investigation plans, managing performance, and providing general guidance on activities.
- Facilitate and implement the complaints and discipline process to ensure legislative compliance, transparency, and administrative fairness, specifically as per the Professional Governance Act.
- Determine appropriate enforcement actions and make recommendations to the Investigations Committee, such as stop orders, license cancellations, remedial work, letters of warning or recommend legal prosecutions.
- May stand in for the Registrar for ASTTBC regulatory matters when they are unavailable or when the Registrar has delegated them functions.
- Collaborates with the practice team as it develops practice standards and works with practice staff to ensure that concerns from routine quality assurance activities are escalated when necessary and identifies trends emerging from investigative matters are addressed from a practice guidance and standards perspective.
- Assists with ensuring the public register has up to date information on the ASTTBC website.
- Works with the CEO, Registrar, Director of Operations, IT staff, external consultants, and provider of ASTTBC’s regulatory information system to ensure that ASTTBC’s regulatory information system meets ongoing evolving regulatory needs.
- Maintains a positive, safe, and functional work environment, including staff performance management and opportunities for development.
- Liaises with other regulators and government officials who work in relation to the Professional Governance Act as it relates to enforcement and discipline.
- Engage with key stakeholders as it relates to enforcement and discipline.
- When needed, prepares for and attends Board meetings, the Annual General Meeting, and special events.
- Contributes to the development and delivery of presentations to key stakeholders.
- Responds to routine and non-routine enquiries from complainants, registrants, organizations, government agencies, and others.
- Works with legal counsel to gather advice to ASTTBC regarding compliance and enforcement, conducting legal research and instructing external counsel (e.g., assigned to a Discipline Committee) as assigned by the Registrar and CEO.
- While external legal counsel will conduct the hearing, the Director will assist legal counsel with accessing documentation, etc., to conduct the hearing on behalf of ASTTBC before Discipline Committee panels as needed.
- Perform other duties as required.
WHO YOU ARE
The ideal candidate will have the following qualifications:
- Bachelor’s degree or college diploma in business administration, public administration, or a related field is required.
- Minimum of five years of demonstrated experience in a managerial and leadership role within a professional regulatory environment.
- Several years of experience at a professional level in regulatory compliance, enforcement, or related functions.
- An understanding of the engineering and applied science technology profession is an asset.
- Legal experience is an asset.
- Exceptional analytical, communication, investigative, and leadership skills. Must possess political astuteness and strong judgment.
- Has experience with investigating complaints, enforcing regulatory standards, issuing consent orders/citations or subpoenas, and ensures compliance with bylaws, legislation, or tribunal rules.
- Excellent understanding of regulatory functions and ability to interpret regulatory statutes, bylaws, and other relevant legislation.
- Understanding of administrative law principles and ability to demonstrate fairness, impartiality, and good judgment.
- Strong interpersonal and verbal communication skills.
- Demonstrated ability in negotiation, conflict management and mediation or dispute resolution.
- Ability to make timely and unbiased decisions.
- Demonstrated ability to promote teamwork, collaboration, and partnership.
- Can synthesize various elements of an issue or problem, readily discern key issues, and prioritize accordingly. Can resolve problems quickly and effectively, determining appropriate courses of action.
- Proficiency using Microsoft software applications, computer, and communication technology.
- An understanding of the engineering and applied science technology profession is an asset.
