Job Description
Job Position: HEAD- LEGAL
Job Location: Chandigarh
Experience: 15-20 Years
Age- 40-45 years
Qualification: Bachelors / Masters in Law
Desired Profile: preference will be given to candidates from Real Estate Company.
Budget – 25 LPA TO 30 LPA
Job Responsibilities:
- Advise the company on the litigation risks of possible business decisions, providing preventive counselling with respect to the legal risks associated with business practices
- Develop strategy with both inside and outside counsel in response to civil litigation and regulatory inquiries (including negotiating settlement agreements where appropriate
- Participate in high level planning organizing meetings and give legal advices to avoid any ban and lawsuit
- Develop and manage the budget of the Legal function
- Oversee the Legal function, including assuring that high quality legal services are provided through oversight of day-to-day
- Perform due diligence in deals/tie-ups and provide the report to the relevant parties / internal clients
- Assess legal documents of the organization and to ensure legal protection of the organization
- Ensure legal compliance in terms of tax payments, assets maintenance, agreements of lease and other obligations are fulfilled in time
- Resolve legal deals and assess the real estate value on behalf of the organization
- Manage litigations and lawsuits, providing legal guidance to the company wherever required
- Monitor and minimize the costs incurred in litigations, penalty, claim amounts paid
- Keep abreast of the latest changes in laws and legal regulations
- Manage other legal matters and projects as requested by the Chief Executive Officer.
1. Regulatory Compliance & Approvals
- Ensure full compliance with RERA Punjab, including project registrations, updates, quarterly compliances, and handling queries/notices.
- Liaison with PUDA, GMADA, MC Chandigarh, DTCP, Town & Country Planning, Pollution Control Board, Fire Department, Environment Department, and other statutory bodies for approvals and NOCs.
- Manage legal processes related to land acquisition, land use changes (CLU), building plan sanctions, and completion/occupation certificates.
2. Legal Documentation
- Draft, review, and vet legal documents including:
o Sale deeds, agreements to sell, builder-buyer agreements
o Lease deeds, collaboration agreements, MOUs
o Power of Attorney, Affidavits, Indemnities
- Ensure accuracy and legal soundness in all property-related documentation.
3. Disputes & Litigation Management
- Handle consumer complaints, civil disputes, RERA cases, arbitration matters, and coordinate with external legal counsel.
- Prepare replies, affidavits, and documentation for courts/RERA authorities.
4. Due Diligence
- Conduct title verification and legal due diligence for land parcels and joint venture projects.
- Assess risks and provide recommendations to management.
5. Government Liaison & Coordination
- Maintain strong relationships with government officials and departments for timely processing of approvals.
- Proactively follow up for sanctions, NOCs, renewals, and compliance-related submissions.
6. Internal Advisory
- Advise management on legal implications of business decisions, new regulations, and risk mitigation strategies.
- Train internal teams on RERA, compliance requirements, and legal processes.
7. Liaisoning & Co-ordination
➢ Department of, Local Bodies & Town Country Planning, Local Bodies of Haryana, Punjab for Change of Land Use, license & various other approvals
➢ Pollution Control Boards of Haryana, Punjab, regarding Environment Clearance, N.O.C, consent to Establish, Consent to operate
➢ Real Estate Regulatory Authority of Punjab for registration of projects
➢ Departments of Punjab Energy Development Agency (PEDA) for approval of SPV Power Plant
➢ HVPNL, DHBVN, PSPCL, PSTCL for clearance of feasibility, right of way for transmission of lines. Chief Inspector Electrical of Haryana, Punjab for inspection of transformer.
➢ HSIDC, Punjab Investment Board, Punjab Small industries & export Corporation for approval of mega residential & Industrial Projects
8. Land Acquisition: -
➢ Identification the land for residential & commercial development,
➢ Negotiation of terms and condition property rates with owners, Due–Diligence of revenue records.
➢ Title verification, evaluation of land, consolidation of Land in Punjab.
➢ Registration of land, transfer of land,
➢ Execution of lease Deeds, Deed of Conveyance, Measurement,
➢ Settlement of issues pertaining to land with Authority & Owners
Key Skills & Competencies:
- Excellent knowledge of RERA Punjab, PUDA/GMADA regulations, and municipal by laws.
- Strong experience in liaisoning with government authorities.
- Expertise in real estate laws, land laws, and construction compliance.
- Strong drafting, negotiation, and communication skills.
- Ability to handle litigation, consumer issues, and regulatory matters independently.
- High ethical standards and attention to detail.
Pay: ₹250,000.00 - ₹300,000.00 per hour
